SECTION 21 – Your Order and Contract
Your order for goods is accepted and a contract is formed between MaryJaneDays Limited (“we, “us”) and you when we despatch the goods you have ordered and not before. No contract is formed at the time that payment is made, or has been taken from you by MaryJaneDays Limited, nor at the time that you receive an email from us acknowledging receipt of your order.
Up until the time that the goods are despatched, your order may not be accepted by MaryJaneDays Limited, or may be cancelled by you.
For security reasons we may restrict the volumes of certain items to be sold in any one transaction.
The goods advertised on our website are intended for sale to persons dealing as consumers and are not for re-sale.
Once the contract is in place between you and us, MaryJaneDays Limited shall continue to own any goods ordered until it has received payment in full from you, even though the goods may have already been delivered to you. Your contract is with MaryJaneDays Limited, Office 2, 12A Lower Main Street, Lucan, Dublin, K78 X5P8, Ireland.

SECTION 22 – Cancelling Your Order
You have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the goods or service, subject to the exceptions below. Please be aware that your right to cancel does not apply to certain goods that we sell, for example, perishable food items and items where the hygiene seal has been broken.
You must inform MaryJaneDays Limited of your wish to cancel in writing either by letter, email or by using the Order Cancellation Form on our website or by calling us, within a period of 14 days beginning on the day after the day you receive your goods. You must take reasonable care of the goods whilst they are in your possession and not use them. You should return goods to us in their original packaging, wherever possible, within 14 days of informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

SECTION 23 – Delivery
Delivery to Your Home
Delivery to Your Home costs and estimated delivery date are advised on our website at the time you place your order. Current delivery options are (1) An Post Standard Service @ €5.99 or (2) An Post Express Service @ €9.99, with both options for all orders up to maximum total weight of 10kg. Delivery times cannot be guaranteed. We may split your delivery into more than one parcel if all the items you have ordered are not available at the same time. If we do this, we will only charge you once for delivery.

We cannot guarantee delivery times and during sale periods and over Bank Holidays delivery will take longer than usual.
SECTION 24 – Customs Fees
Our terms of sale to our customers in Ireland are usually delivery duty paid. This means, the amount paid by you is fully inclusive of all duties, taxes and customs clearance fees. Where duty is payable this will be met by MaryJaneDays Limited, however the goods advertised on our website are intended for sale to persons dealing as consumers only and not for businesses or for re-sale. We reserve the right to charge customs clearance fees for orders and to accept or reject any order.
SECTION 25 – Returns & Refunds
We hope that you are completely happy with your purchase, however, this policy is in addition to your legal rights and does not affect your right to return items to us.
If you change your mind, simply return the unused item within 14 days after the day you received it and we will refund what you have paid for it. We will issue a refund to the payment method used to pay for the order within 14 days of us receiving the return and checking it.

SECTION 26 – Returns by Post
If you wish to return your order by post, you will need to pay for the return postage and packing costs. Please package the order carefully. We recommend using a recorded delivery service for returns as we cannot be responsible for products which don’t make it back to us and please retain your proof of postage. A refund will be issued to you within 14 days of us receiving your item.

SECTION 27 – Faulty or Damaged Products
We take great care to ensure your items reach you in good condition. However, if you are unfortunate to receive a damaged item, we will happily refund or replace it once the fault or damage is agreed. We will advise you at this time of what action you need to take.

SECTION 28 – Returning Food Products
IF YOU FIND ANY OF OUR FOOD PRODUCTS IN A STATE NOT FOR HUMAN CONSUMPTION, DO NOT EAT AND CONTACT US IMMEDIATELY.
We will happily refund or replace it once the fault or damage is agreed. We will advise you at this time of what action you need to take.

SECTION 29 – Missing Items or Lost Parcels
If you have any missing items from your order or lost parcels, then please contact us immediately.

These Terms and Conditions will be governed exclusively by and interpreted in accordance with Irish Law. You agree to submit to the exclusive jurisdiction of the Irish Courts. All contracts will be concluded in the English language.
